Terms of Service

Acceptance of these Terms

These Terms of Service are a binding agreement between you and the operator responsible for TheOnlineToolset concerning your use of TheOnlineToolset and its tools. By accessing or using the service, you agree to these Terms, the Acceptable Use Policy, the Privacy Policy, the Cookie Policy, and the File Retention and Deletion policy. If you do not agree, do not use the service.

Eligibility and minimum age

You must be at least 13 years old and old enough under the law where you live to consent to use the service. If you are below the age of legal majority, a parent or legal guardian must review and agree to these Terms for you. You may not use the service if applicable law prohibits you from doing so or if you lack authority to accept these Terms for yourself or an organization.

The service and anonymous access

TheOnlineToolset provides automated PDF, image, audio, video, text, developer, and related tools. The current public service can be used without creating an account. Anonymous access does not make activity exempt from these Terms, usage controls, or applicable law, and it does not guarantee that the operator cannot process technical information as described in the Privacy Policy.

A tool description explains its intended function, but features, supported formats, limits, processing time, and availability may differ or change. Submission of a request does not guarantee that processing will start or complete.

Your files, ownership, and responsibility

You retain ownership of and any other rights you hold in files, text, instructions, and other material you submit. The operator does not receive ownership of your content.

You grant the operator only a limited, non-exclusive permission to receive, validate, process, temporarily store, generate, and return content as reasonably necessary to perform the operation you request, secure and maintain the service, and comply with law. This permission ends when it is no longer reasonably needed for those purposes, subject to temporary retention, legal obligations, and the Privacy Policy.

You are responsible for your content and requested operation. You represent that you have all rights, permissions, and lawful authority needed to submit and process the content and that doing so will not violate law, contract, confidentiality, privacy, publicity, intellectual-property, or other rights.

Temporary processing and file availability

Server-backed uploads, generated files, and download links are temporary. They expire and are scheduled for deletion under the File Retention and Deletion policy, but expiry is not a guarantee of deletion at an exact second or irreversible erasure from every possible recovery medium. Files may be removed before a stated maximum because of cancellation, capacity limits, security concerns, suspected violations, maintenance, legal requirements, or system cleanup.

The service is not a backup, archive, or permanent-storage provider. Keep your original files, verify each result, and download wanted outputs promptly. The operator does not guarantee successful processing, recovery of any file, continued access to a link, or permanent availability of any input or output.

Acceptable use

You must comply with the Acceptable Use Policy. Among other things, you may not use the service for unlawful or infringing content, privacy abuse, malicious code, credential theft, phishing, exploitation, non-consensual private material, disruption, unauthorized access, or evasion of safeguards.

Intellectual property and copyright complaints

The service, branding, site design, and operator-provided software and content are protected by applicable intellectual-property laws. Except for ordinary use of the public tools, these Terms do not grant you a license to copy, distribute, sell, or create derivative works from operator-owned material.

If you believe material processed or made available through the service infringes copyright, send a good-faith notice to [email protected]. Include identification of the protected work, the allegedly infringing material and enough information to locate it, your contact information, a statement explaining your good-faith belief, a statement that the notice is accurate and that you are authorized to act, and your physical or electronic signature. Do not resend illegal, harmful, or confidential material merely to report it. The operator may request additional information, remove or restrict material, preserve required evidence, or handle counter-notices as applicable law requires.

Usage limits and automated access

The service applies file-size, file-count, request-frequency, processing, storage, concurrency, and other reasonable usage limits. Limits may vary by tool and may change to protect users, security, availability, or fair access. You may not evade, circumvent, distribute activity to avoid, or interfere with these limits.

Automated, scripted, bulk, scraping, or high-volume access is prohibited unless the operator has expressly authorized it in writing or provides a feature specifically intended for that use. Ordinary browser automation must not burden the service, impair other users, collect data without authority, or bypass controls.

Security and enforcement

You may not probe, scan, test, reverse-engineer, defeat, or exploit the service or its safeguards except to the limited extent such a restriction is prohibited by law or the operator has given written authorization. You may not disrupt service, overload capacity, access another user’s files or links, introduce harmful content, or interfere with security monitoring.

The operator may validate or reject inputs, limit requests, block access, cancel processing, disable links, remove files, preserve evidence, and investigate suspected misuse when reasonably necessary for security, legal compliance, abuse prevention, or protection of the service or others. These measures are discretionary safeguards, not a promise that all harmful activity will be detected or prevented.

Service changes and availability

The operator may add, modify, suspend, restrict, or discontinue any tool or the service, temporarily or permanently. Tools may be unavailable because of demand, maintenance, security, legal concerns, technical failure, or business decisions. The operator does not guarantee uninterrupted, timely, secure, or error-free availability and is not required to preserve a particular feature, format, limit, or workflow.

Output accuracy and quality

Automated outputs may be incomplete, inaccurate, corrupted, incompatible, lower quality than expected, or unsuitable for your purpose. Processing may alter metadata, formatting, timing, color, resolution, accessibility, signatures, protections, or other characteristics. You must inspect results before relying on, publishing, or deleting an original. The tools do not provide legal, medical, financial, safety, preservation, or other professional advice.

Third-party services, links, and advertising

The service may rely on or link to third-party resources. Third parties operate under their own terms and privacy practices, and the operator is not responsible for third-party content, availability, security, or conduct. A link or technical integration does not imply endorsement.

Advertising is currently disabled by default. If advertising is enabled later, ads may be selected, delivered, and measured by third parties subject to applicable consent choices, the Privacy Policy, and the Cookie Policy. The operator does not endorse or guarantee an advertised product or service.

Possible future accounts and paid features

The current MVP does not require accounts or offer paid subscriptions. The operator may later introduce accounts, usage tiers, subscriptions, payment terms, or premium functionality. Any such feature will be governed by additional or updated terms presented before it applies. Nothing in these Terms promises that a future feature will be launched.

Restriction, suspension, and termination

The operator may restrict, suspend, or terminate access, reject or cancel jobs, or remove content when reasonably believed necessary to address a violation, legal request, security risk, abuse, harm, non-payment for a future paid service, or material operational risk. Where practical and appropriate, the operator may provide notice, but immediate action may be necessary and anonymous access may make notice impossible.

You may stop using the service at any time. Provisions that by their nature should continue— including ownership, disclaimers, liability limits, indemnity, dispute terms, and enforcement rights—survive termination to the extent applicable.

Disclaimer of warranties

To the fullest extent permitted by law, the service is provided “as is” and “as available.” The operator disclaims implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, and quiet enjoyment. The operator does not warrant that the service or outputs will meet your needs, preserve all data or characteristics, be free of harmful components, or operate without interruption or error. Some jurisdictions do not allow certain disclaimers, so parts of this section may not apply to you.

Limitation of liability

To the fullest extent permitted by law, the operator and its personnel and contractors will not be liable for indirect, incidental, special, exemplary, punitive, or consequential loss, or for lost data, files, profits, revenue, business, opportunity, goodwill, or anticipated savings arising from the service, even if advised that loss was possible.

To the fullest extent permitted by law, total liability for all claims connected with the service will not exceed the amount you paid the operator for the affected service during the 12 months before the event giving rise to the claim, or the minimum amount that applicable law requires, whichever is greater. These limits do not exclude liability that cannot lawfully be limited, including liability for fraud, willful misconduct, gross negligence where applicable, or death or personal injury caused by negligence where exclusion is prohibited. Mandatory consumer rights remain unaffected.

Indemnity

To the extent permitted by law, if you use the service on behalf of a business or for commercial purposes, you will defend and indemnify the operator against reasonable third-party claims, damages, and costs arising directly from your unlawful content, your infringement or violation of another person’s rights, or your material breach of these Terms or the Acceptable Use Policy. This obligation does not apply to the extent a claim results from the operator’s own misconduct, and the operator must provide reasonable notice and cooperation and may control the defense without agreeing to a settlement that admits wrongdoing by you without your consent.

Governing law and disputes

Governing law, available courts, and mandatory consumer protections are determined by the laws that apply to the operator and the user.

Before filing a formal claim, you and the operator should try in good faith to resolve the dispute through the contact channel, unless urgent relief or applicable law makes that impracticable. These Terms do not impose mandatory arbitration or waive a right to participate in a class proceeding unless a future, legally reviewed agreement expressly says otherwise.

Severability and no waiver

If a provision is found unenforceable, it will be limited or removed only to the minimum extent necessary, and the remaining provisions will continue in effect. A failure to enforce a provision is not a waiver. These Terms and the policies incorporated above form the agreement concerning the current public service unless additional terms expressly apply.

Changes to these Terms

The operator may update these Terms to reflect service, legal, security, or business changes. The effective date will be revised, and additional notice will be provided where required. Changes apply prospectively from their stated effective date. If you do not agree to updated Terms, stop using the service.
